Why wouldn't you just take the picture while he (the bear) was asleep? Then go your way. It may be safer! But as far as being illegal or not, I don't know.

It is illegal to harass any sort of wildlife including sleeping bears. A friend of mine came across a bear sleeping on a trail while returning to his boat. From a safe distance they called out to the bear which woke and then climbed up into the woods. My friend was then allowed to continue along the trail.
